WHAT YOU CAN EXPECT from Daniella Marinos Photography and team.
Pre Consultation - We will consult with you as the clients prior to your wedding to review any requests regarding desired images, go over the timeline for your wedding, and if possible, view the venue in advance of the day.
Prior to your wedding day we will be in contact as many times as required to ensure we have every last detail.
On the day of the wedding, Daniella Marinos Photography & Team will arrive at the contracted starting time, provide photography services for the time duration specified for the day as per contract, concluding services at the agreed on time, unless you as the client and Daniella Marinos Photography agree to extend services.
Daniella Marinos Photography will review all images from the wedding and edit those that are in keeping with the highest quality and style of Daniella Marinos Photography work. Daniella Marinos Photography reserves the right to withhold any images not in keeping with their standards. · Daniella Marinos Photography will present your digital proofs via a USB or online gallery within 8 weeks of your wedding, at this stage, Daniella Marinos Photography will confirm when other elements of your agreed package will be available for you.
Additional products can be ordered via telephone or in-person, online email or in the initial meeting, and orders placed with your photographer are typically available for collection within 12 weeks from the date of the ceremony. Your backed-up gallery remains available for a maximum of 180 days. Please ensure you download all of your images in one go prior to the 180 days expiry.
The Daniella Marinos Photography team are honoured and delighted to be chosen as your photography and videography team and will strive to exceed your expectations and provide images that delight you and that are treasured for years to come.
STANDARD TERMS AND CONDITIONS BOOKING FEE: A non-refundable booking fee of £250 for photography & £250 for videography for each date booked is required at the time of booking, together with a signed contract. This is non refundable even in the event of a Force Majeure, although an alternative date may be offered in if a cancellation is valid due to COVID 19.
DATES: All dates are reserved only when this booking fee is paid. This is required on all bookings unless stipulated in writing by Daniella Marinos Photography (In which case evidence of this is to be attached to these Terms & Conditions explaining the reason for the non-payment of a booking fee)
METHOD OF PAYMENT: Daniella Marinos Photography accepts the following methods of payment: v Direct Bank Transfer (BACS) –bank details are on the contract.
BALANCE PAYMENT: A balance payment of the agreed amount is to be made not later than 3 months prior to the date of the wedding. payment plans are available at the discretion of Daniella Marinos Photography.
In the event of the balance not been paid 3 months prior to the wedding Daniella Marinos Photography reserve the right to withdraw their services with no refund of the deposit and have the right to charge a £150 late payment fee.
Please remember Daniella Marinos Photography is a business and is committed like any other business with expenditure for equipment and staff.
PAYMENT: For additional albums, photographs, prints & frames, payment is made after the wedding or at the time of ordering .
ADDITIONAL EXPENSES: The Couple are responsible for all travel and accommodation costs if the Event is taking place over 50 Miles away from our premises, this will be discussed at the time of securing your booking and at the discretion of Daniella Marinos Photography.
PLEASE ALSO: Note we do advise for Weddings where coverage lasts more than 5 hours, we ask that to keep energy levels up of the photographers that a hot meal & refreshments are provided for each videographer/videographer.
FEES: This includes all photography, expenditure for your full package.
PRINTS: Prices for wedding prints are based on the reprint price list + p&p at the time of ordering. Please consult with Daniella Marinos Photography for advice on sizes before purchasing frames.
ALBUMS: If you had selected an album with your chosen package you will be then invited to an album planning session where we will work together on the composition of your album. N/A with Competition Winners.
Please note: Album designs must be completed & approved within 6 weeks from the date received due to the timescale and ordering thereafter. After the 6 week period there is a late fee of £100. Album Photo covers are not included in any collection booked and there is an added fee. ( subject to change due to price increases ) The albums included in the Emerald / Diamond collections 1 10x10 album with 10 double page spreads. Should the client want to add additional pages there is an extra fee based on the current price list.
CREATIVE LICENCE: You as the client grant Daniella Marinos Photography all copyright access for all purposes and agree that Daniella Marinos Photography can use the images for any purpose seen fit for advertising, creative and artistic licence in relation to the choice of locations and poses used. Daniella Marinos Photography’s judgement on photographic style and the number of photographs taken shall be deemed correct.
CLIMATE/WEATHER:
Due to changes of the weather and the availability and willingness of subjects, Daniella Marinos Photography will endeavour to capture requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.,
EXCLUSIVITY: Daniella Marinos Photography or one of her team will be the professional (still) photographer or videographer at the venue/event specified.
We do however positively encourage family, friends, and other guests to take photographs throughout the day. However, cannot be held responsible for images that are not fulfilled due to guest obstruction.
COLOUR MATCHING: In all cases Daniella Marinos Photography takes care to ensure that the natural light is used for their style, to ensure that final prints match the image seen on screen and at the proofing stage wherever possible. It is, however, impossible to guarantee colour accuracy 100% due to the different colour spaces that occur in digital imaging and different printers, media, screens and software settings. We take steps to minimise problems of colour rendition but there may be differences and as such colours viewed on screen should only be taken as a guide. If you have any concerns in this respect, please seek our advice.
COPYRIGHT The 1998 Copyright: Designs, and Patents Act assigns copyright to Daniella Marinos Photography. You may not copy the photographs taken under this Contract, or allow copies to be made photographically, electronically, or by any other means, unless printing rights have been passed to you in writing. Printing rights allow the reproduction of your images for your personal use, the use of any images captured by Daniella Marinos Photography for Commercial purposes is strictly forbidden without prior consent, any breaches of this will be billed at our commercial rates.
MODEL RELEASE : We reserve the right to use any images taken by us for marketing, advertising, blog, social networking and promotional purposes. The Client hereby grants to Daniella Marinos Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases Daniella Marinos Photography and its legal representatives and assigns from all claims and liability relating to said photographs. However, discretion is important to us, and we will consider any written request for anonymity, and avoid using any photographs that are not in line with the standards of Daniella Marinos Photography
FORCE MAJEURE: In the unlikely event of total photographic failure, injury or sickness beyond Daniella Marinos Photography’s control, their liability shall be limited to offering an alternative photographer/videographer wherever possible. Our policy of all monies paid due to the nature of our business is Non-Refundable.
BANK HOLIDAYS: All bank holiday weddings will have an extra fee added to their booking due to the nature of the business, this feel will be a standard fee of £250 per Bank holiday
We cannot accept responsibility in the event of having to change or amend your booking due to circumstances beyond our control. We cannot accept responsibility where venues/3rd party suppliers are be affected by bad weather and conditions and circumstances beyond our control. We will do everything possible to make sure your day goes ahead as planned but the weather conditions may force you to make necessary changes to your wedding venue and/or reception and date last minute.
If you have to change your wedding arrangements due to any reason including but not limited to the above, we will be able to offer you an alternative date wherever possible. If you accept the alternative date, then the price will be adjusted accordingly whether higher or lower. Refunds will not be given for change of dates but alternative dates or team members will be wherever possible. Should dates be changed without notification all monies will be forfeited. Wedding date changes should be discussed with Daniella Marinos Photography at all times to check for availability. Each date booked will require a non refundable booking fee of £250.
We are subject to the law in the said country and cannot be held responsible for any changes made by the authorities/municipality office regarding the procedure of weddings.
For the avoidance of doubt we will not be liable for any additional costs/losses that you or any of your wedding party may incur as a result of any change or cancellation by us as per above due to reasons beyond our control including, but not limited to alternative wedding arrangements, holiday and flight cancellations.
Your statutory rights are not affected. Daniella Marinos Photography carries full Public Liability, and Professional Indemnity Insurance. Daniella Marinos Photography.
RIGHT TO CANCEL : You as the consumer have a right to cancel at any time during the cancellation period of 14 days from signing the contract, without giving any reason, and without incurring any liability. We request that the cancellation is detailed in writing or by email within the said time frame and a full refund will be given.
The cancellation period ends at the end of 14 days after the day on which the contract is entered into. As the consumer if you exercise your right to cancel after having made a request in accordance with regulation 36(1) which stipulate the request must be in writing, the consumer is to be liable to pay the trader reasonable costs of 50% of the full fee as non-refundable in accordance with regulation 36(4).
Cancellation costs for cancellation requests received after the 14-day period are as follows: 100% (booking fee) non-refundable & 50% of the full fee non refundable, due to loss of business and closure of the date booked and all administration costs.
CANCELLATION WITHIN £ MONTHS OF THE DATE: Will be 100% non refundable due to bookings being turned away and loss of business for closing the date. Should the ability of fullfilling this date with another booking then 50% will be refunded of the booking fee.
COMPETITION WINNERS: For all competition winners a cancellation fee will also occur should you not wish to take the gift and a 14 day notice is not given in writing to Daniella Marinos Photography. You as a client are bound by the same contractual terms if you decide to not participate and do not give the above notice period once the contract has been signed and sent to Daniella Marinos Photography.
CANCELLATION: BY Daniella Marinos Photography,
If Daniella Marinos Photography has to cancel this contract for reasons beyond their control, (death, injury, sickness circumstances beyond control, government law but not limited to as above), their liability shall be limited to a offering an alternative date. Daniella Marinos Photogrpahy will endeavour to find a replacement from one of its team members wherever possible to avoid such an unfortunate situation. This hasn’t happened to date but please rest assure we try our best to always have a back up with the same style and professionalism wherever possible.
DESTINATION WEDDINGS/PHOTOGRAPHY:
All weddings overseas outside of the UK will have the same Terms & Conditions with a Non-Refundable deposit/fee due to the nature of the business. Circumstances beyond our control such as flight cancellations, Venue cancellation, 3rd party limitations, but not limited to……
The terms and conditions are explained to us by the suppliers of the venues and where their circumstances are beyond our control, so we will therefore not be liable for any changes to their terms and conditions and circumstances including, but not limited to damages/losses/closure of these venues due to fire, flood, natural disaster, bad weather, industrial action, legal licensing and any consequent changes you the client or any 3rd party supplier may have to make as a result and any extra costs you may occur due to these changes..
Daniella Marinos Photography will however offer alternative dates wherever possible should this be required.
AGREEMENT:
When undertaking services from Daniella Marinos Photography & Videography you as the client have read & fully understand the terms & conditions of this agreement and realise that this contract becomes effective immediately from the time the booking fee has been paid. You agree that cancellation rates will apply in case of any cancellation by us or any 3rd party supplier of circumstances beyond our control. By confirming and booking with Daniella Marinos Photography and Videography , you agree to the terms above and that Daniella Marinos Photography has the right to discuss the package with either party.
